Wynns Wine Club Terms & Conditions

1.     Wynns Coonawarra ABN 55 004 094 599 (Wynns) operates the Wynns Wine Club program for members of wynns.com.au, which features three (3) Tiers (Program).

2.     All members of Wynns with an Australian residential address are automatically eligible to participate in the Program.

3.     By participating in the Program, you agree to the Terms and Conditions of the Program set out herein and our Privacy Policy. Please read these Terms and Conditions, Conditions of Sale, and Privacy Policy carefully before you use and/or participate in the Program. By providing us with your details to join the Program, you agree to the collection and use of your personal information for the purposes of participating in the Program in accordance with our Privacy Policy, and understand you will always be provided an opportunity to unsubscribe.

Program Tiers

“Anniversary Date” refers to the date and month a member signed up to the Program or an alternative date approved by Wynns. 

Each Anniversary Date, a member’s Tier will be allocated based on the number of Tier Points earnt in the 12 months since their last Anniversary Date. A member may be upgraded to a higher Tier at any time if they have earnt enough Tier Points to qualify for a higher Tier.

Members will be notified by email if they move to a higher Tier and will received details of the additional benefits they are entitled to. Please note that on each Anniversary Date, your Tier Points will be reset to 0.

Each member will be allocated (or not allocated, as applicable) to a Tier as follows:

Tier Points are allocated based on Eligible Spend as defined below.

Members will earn 1 Tier Point for every $1 (incl. GST) of Eligible Spend.

Eligible Spend

Only certain types of expenditure will count towards a member’s Eligible Spend. This includes:

  • purchases through the wynns.com.au website;
  • purchases via Wynns telephone sales;
  • purchases at official Wynns events;
  • purchasing tickets to official Wynns events;  or
  • purchasing via special promotions (which may have bonus tier points) as communicated by Wynns via email from time to time.

Refunds, returns or purchases made using points, discount vouchers or discount codes do not count towards Eligible Spend. However, purchases made using Gift Vouchers do count towards Eligible Spend.

The following terms apply to the Program benefits listed in the above table:

1.        Benefits or offers cannot be transferred, exchanged or redeemed for cash.

2.        Birthday vouchers cannot be used in conjunction with any other discount vouchers or codes and are subject to any further terms stated on or with the vouchers. Limit one (1) birthday voucher per person per year. Members will only be notified if they are subscribed to receive emails.

3.        Only members of the Program are eligible to use and redeem any Program rewards, benefits or offers. Only members who receive our emails are eligible to use and redeem any Program rewards, benefits or offers.

4.        Any rewards, benefits (including bonus gifts with purchase) or other offers communicated as part of the Program:

(a) may include specific offer terms and conditions, including expiry dates and redemption conditions;

(b) are subject to availability and if a benefit (or element of a benefit) is unavailable for any reason, Wynns may provide another benefit of equal or higher value;

(c) are subject to change at any time as determined by Wynns in its absolute and sole discretion.

Change of Details

To ensure you continue receiving our communications – including details about Program reward, benefits and offers – you will need to notify Wynns of any change of name, address, contact number or email address. You can update your details online at www.wynns.com.au or calling us on 1300 768 074.

Liability

1.     Nothing in these Terms and Conditions restricts, excludes or modifies any consumer rights that members may have under any statute including the Competition and Consumer Act 2010 (Cth).

2.     Except for conditions, warranties and representations expressly stated in these Terms and Conditions, to the extent permitted by law each party excludes all conditions, warranties and representations under or in connection with the Program and these Terms and Conditions.

3.     To the extent permitted by law, a party's liability for breach of any condition, warranty or guarantee imposed by statute that cannot be excluded and the other party's sole and exclusive remedy in relation to such breach will be limited to (at the first party's election):

A.    in the case of goods:

i.           replacement or repair of the goods or supplying the equivalent goods again; or

ii.           paying the cost of replacing or repairing the goods or of acquiring equivalent goods; and

B.    in the case of services:

i.           supplying the services again; or

ii.           paying the cost of having the services supplied again.

4.     To the full extent permitted by law, neither party is liable to the other party for any Consequential Loss arising out of or in relation to the Program or Terms and Conditions. In this clause, Consequential Loss means special, incidental, punitive, exemplary, indirect or consequential losses, as well as business interruption losses, loss of revenue, anticipated savings, profits, goodwill, reputation, interest or business opportunity, and loss of information or data (including the costs of recovering or reconstructing any lost or corrupted data).

5.     Each party's total aggregate liability in respect of any claim, loss, damage, expense or liability arising under or in connection with the Program or these Terms and Conditions (including in negligence) will not exceed $10,000.

6.     Each party's liability under or in connection with the Program or these Terms and Conditions (including in negligence) will be reduced by the extent, if any, to which the other party contributed to that liability.

General Terms and Conditions

.     TWE is not responsible for any tax implications arising from any member participating in the Program or receiving any benefit under it.

2.     TWE may exclude or suspend a member from the Program or from receiving benefits under the Program if the member:

A.    engages in any conduct that may jeopardise the fair and proper conduct of the Program;

B.    acts in a disruptive, annoying, threatening, abusive or harassing manner;

C.    does anything that may diminish the good name or reputation of Wynns, its brands, or any of its related entities or contractors;

D.   breaches any law in connection with the Program or their participation in the Program; or

E.     behaves in a way that is otherwise inappropriate in Wynn’s reasonable opinion.

3.     Neither party will be responsible for a failure to perform any obligation under these Terms and Conditions or in connection with the Program to the extent that it is caused by a Force Majeure Event, provided that such party has:

A.    taken all reasonable steps to prevent and avoid the effects of the Force Majeure Event;

B.    taken all reasonable steps to overcome and mitigate the effects of the Force Majeure Event as soon as reasonably practicable; and

C.    provided reasonable notice to the other party of the impact of the Force Majeure Event.

In this clause, Force Majeure Event means an event or circumstance whose occurrence and effects could not reasonably have been prevented or overcome, such as earthquake, war, natural disaster, fire, flood, storm, riot, civil commotion, industrial dispute, malicious damage, failure of any utility service or transport network, virus, denial of service attack, other acts or omissions or service outages by third parties, or breakdown of plant or equipment.

4.     A member must not assign or attempt to assign any right or liability under these Terms and Conditions without the prior written consent of Wynns. Wynns may assign its rights and liabilities under these Terms and Conditions, or novate these Terms and Conditions, to a related company that has the resources and expertise to fully perform these Terms and Conditions and each member must provide all reasonable co-operation for this purpose.

5.     Any term of these Terms and Conditions that is expressed to survive, or by its nature survives, the termination or expiry of these Terms and Conditions will survive and continue in effect following termination or expiry of these Terms and Conditions.

6.     All references to $ in these Terms and Conditions are to Australian dollars.

7.     Wynns may amend these Terms and Conditions from time to time, provided that the amendments do not cause unreasonable financial or other detriment to members. The amended Terms and Conditions will apply from the time they are posted on the Wynns website or otherwise notified to members.

8.     Wynns may terminate the Program by notifying members on the Wynns website or otherwise, provided that Wynns provides sufficient notice so that the termination does not cause unreasonable financial or other detriment to members.

9.     These Terms and Conditions are governed by the laws of Victoria, Australia.
